Website Terms and Conditions

Welcome to the Caving Academy's Terms and Conditions regarding the use of the website and the content contained within it ("Website"). We are supposed to tell you, in all CAPITAL LETTERS, to carefully read these Terms and Conditions before using the Website. Further, that you must be legally competent (ie. old enough that the government says you can make your own decisions, don't have any bats in the belfry, aren't drunk or high, etc) to agree to and comply with all the Terms and Conditions, or you are forbidden from using the Website. That means by using the Website you are inherently agreeing to these Terms and Conditions, which constitute a legally binding agreement between Caving Academy and yourself, and one which is (of course) to the benefit of us, not you. Oh, and you need print out a copy for your records (but you could be a deviant and save a digital version).

However, It's all lies! Well, sort of. To be a legally binding contract, or enforcable, we'd have needed to provide proper and obvious notification that the Website Terms and Conditions exist, provided an effective way to review them, and required affirmative consent from you (check in a box saying "I Agree"). Just putting a link to the Terms and Conditions in the footer fails miserably to meet this court-enforced standard, and renders any Terms and Conditions pretty much useless.

What does it all mean? We don't currently have any Terms and Conditions regarding the general use of the Website because they wouldn't hold up in court anyway. One day we may establish a combined "Cookies Alert" and "Terms and Conditions" agreement as one of those modals (popups)...but if we make the website too annoying and a pain to access, it's just bad all around. Alternately, we may establish a "Resources Terms and Conditions" which you need to agree to before accessing resources...The real issue is that we don't have a Uniform Website Code enacted by all jurisdictions that establishes a reasonable baseline associated with the use of websites. Look at us, hoping the government would actually be competent. While we are dreaming, can you just feel the air blowing out of that new lead?!

(Maybe we should run this through a spell-checker? Oh well, so many caves, so little time.)

Your privacy is important! As a caver, you probably have some deep (hopefully very deep) dark secrets and you want to protect them. We support this, and take seriously the responsibilities that come with having knowledge! We are pleased to commit to using information purely for the good of yourself, Caving Academy, and the caving community!

Seriously though, this really is our policy: Collect and use information for the good of the Caving Academy, the caving community, and the individual who shared information with us. The reason for this policy is because anything else becomes overwhelming for everyone. It's complex to write, difficult to keep up-to-date, and, most importantly, hard to understand in a reasonable amount of time.
